Car Sales from Abroad: Lawyers Pointed Out an Important Nuance.


Many Ukrainians are concerned about the issue of re-registering a vehicle when the owner is abroad. To avoid problems in the future, experts suggest two options for resolving this situation:
'There are two options for solving the problem: the owner can re-register the car through the Diia app or issue a power of attorney at the consulate or from a foreign notary,' explains lawyer Vladislav Deriy in his response to a user's question.
The first option involves re-registering the vehicle through the Diia app. This method does not require payment of taxes for the first sale of the car. After signing the documents, they are transferred to the administrator of the MVS service center, who secures the numbers and issues a registration certificate. The selected package of documents is received by the buyer via the Ukrposhta postal office, and electronic documents appear in the Diia app.
The second method is to issue a power of attorney for the sale of the vehicle at the consulate or from a foreign notary. In some cases, an apostille may be required. However, it is important to remember that the power of attorney must be issued to a third party who will accompany the buyer to the MVS service center or notary for the re-registering of the vehicle.
To re-register the vehicle, it is necessary to provide documents that confirm the ownership rights. Among them are documents that confirm the legality of the acquisition, an application, a registration certificate, the passport of the buyer and seller, a copy of the tax payer's registration number certificate, and payment documents that confirm the payment for the services of the administrative center.
In case of a change of owners, no deregistration of the vehicle is conducted. Expert examination is not mandatory and is carried out at the discretion when re-registering.
